1. DEFINITIONS AND INTERPRETATION
In these Terms and Conditions, the following words and expressions shall bear the meanings assigned to them below:
"Company", "We", "Us", "Our": refers to Leefsteil (PTY) LTD, registration number 2026 / 003639 / 07, a private company incorporated in South Africa.
"Consumer": any natural person who enters or intends to enter into an electronic transaction with us as the end user of the goods or services, as defined in section 1 of the Electronic Communications and Transactions Act 25 of 2002 ("ECTA").
"CPA": the Consumer Protection Act 68 of 2008, as amended.
"Customer", "You", "Your": any person accessing or using this Website, whether as a Consumer or otherwise.
"ECTA": the Electronic Communications and Transactions Act 25 of 2002, as amended.
"Goods": any physical products listed for sale on this Website.
"Information Regulator": the Information Regulator of South Africa established under POPIA.
"Order": a request by you to purchase Goods or Services from us via the Website.
"Personal Information": has the meaning ascribed to it in POPIA.
"POPIA": the Protection of Personal Information Act 4 of 2013, as amended, including the amendments effected by the POPIA Regulations published in Government Gazette No. 50738, 17 April 2025.
"Price": the total purchase price of Goods or Services including applicable taxes.
"Privacy Policy": our separate Privacy Policy available on this Website, which forms part of these Terms and Conditions.
"Services": any services offered or supplied by us via this Website.
"VAT": Value-Added Tax levied in terms of the Value-Added Tax Act 89 of 1991.
"Website": our e-commerce website accessible at www.leefsteil.com and all associated pages, subdomains, and mobile-optimised versions thereof.
1.1 Words importing the singular include the plural and vice versa. Headings are for convenience only and do not affect interpretation.
1.2 References to legislation include any amendments, re-enactments, or successor legislation.

2.1 We are not a member of any self-regulatory or accreditation body at the date of these Terms. Should this change, we will update this clause accordingly.
2.2 The security certificate and encryption measures applicable to this Website are displayed in your browser's address bar. We employ industry-standard SSL/TLS encryption on all pages involving personal or financial data.
3. ACCEPTANCE OF TERMS
3.1 These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you and the Company governing your use of the Website and any Order placed.
3.2 By clicking 'I Accept', ticking an acceptance checkbox, completing an account registration, placing an Order, or otherwise using this Website, you confirm that:
- you have read, understood, and agree to be bound by these Terms and Conditions;
- you are at least 18 years of age or have the consent of your legal guardian;
- you have legal capacity to enter into binding contracts under South African law;
- where you transact on behalf of a juristic person, you are duly authorised to do so.
3.3 We reserve the right to amend these Terms and Conditions at any time. Amendments become effective upon publication on the Website. Continued use of the Website after publication constitutes acceptance of the amended Terms.
3.4 In the event of a conflict between these Terms and Conditions and any other document on the Website, these Terms and Conditions shall prevail unless expressly stated otherwise.
4. ELECTRONIC TRANSACTIONS AND CONTRACTS (ECTA)
4.1 Contracts concluded on this Website are electronic contracts governed by ECTA. Such contracts are valid and legally binding in accordance with section 11 and section 22 of ECTA.
4.2 An agreement between you and us is concluded at the time and place where your acceptance of our offer is received by us, as contemplated in section 22(2) of ECTA, subject to our right to reject or cancel Orders as set out in clause 7.
4.3 An Order confirmation email sent by us does not necessarily constitute final acceptance of your Order. Acceptance occurs when we dispatch the Goods or confirm the commencement of Services.
4.4 You acknowledge that electronic communications constitute valid, binding agreements and that you will not dispute the validity of any transaction solely on the ground that it was concluded electronically.
4.5 We provide you with the opportunity to review, correct, or withdraw from a transaction prior to final submission, in accordance with section 43(2) of ECTA. Please review your Order summary carefully before clicking 'Place Order'.
5. PRODUCTS, SERVICES, AND PRICING
5.1 Product Descriptions
We take reasonable care to ensure that product descriptions, images, and specifications on the Website are accurate. However, we do not warrant that product descriptions are error-free, complete, current, or reliable. If a product differs materially from its description, your sole remedy is to return it unused in accordance with clause 10.
5.2 Pricing
(a) All prices displayed on the Website are in South African Rand (ZAR) and include VAT at the applicable rate, unless expressly stated otherwise.
(b) Prices are subject to change without prior notice. The price applicable to your Order is the price displayed at the time your Order is placed, subject to clause 5.3.
(c) Delivery charges, if any, are displayed separately during checkout and are payable in addition to the product price.
(d) We are VAT-registered in South Africa. Our VAT registration number is 9228481280. A valid tax invoice will be issued for each purchase.
5.3 Pricing Errors
If we discover a pricing error on any item you have ordered, we will notify you as soon as reasonably possible. You may then confirm your Order at the correct price or cancel it. If we are unable to contact you, we will treat the Order as cancelled and provide a full refund. We are under no obligation to supply Goods at an incorrect lower price.
5.4 Availability
All Orders are subject to availability. If an item is out of stock after you have placed an Order, we will notify you immediately and refund any payment in full within 30 days, in compliance with section 46(3) of ECTA.
6. PLACING AN ORDER
6.1 To place an Order you may be required to register an account. You agree to provide accurate, current, and complete information and to update this information as required.
6.2 You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
6.3 Each Order constitutes an offer by you to purchase the specified Goods or Services at the stated price, subject to these Terms.
6.4 We reserve the right to refuse, limit, or cancel any Order at our discretion, including where:
- the Order appears to be fraudulent or made in bad faith;
- you have previously breached these Terms;
- the Goods are unavailable;
- a pricing or other error has occurred;
- you are under 18 years of age.
6.5 If we cancel an Order already paid for, we will refund the full amount within 30 days of cancellation.
7. PAYMENT
7.1 Payment is due in full at the time of placing an Order unless otherwise agreed in writing.
7.2 We accept the following payment methods: [credit/debit cards, EFT, instant EFT, e-wallet — specify your accepted methods]. All payments are processed in ZAR.
7.3 In accordance with section 43(5) of ECTA, we utilise a payment system that is sufficiently secure with reference to accepted technological standards. All card transactions are encrypted using SSL technology and processed through PCI DSS-compliant payment gateways.
7.4 We do not store your full card details. Payment card information is handled directly by our third-party payment processor.
7.5 Title in Goods passes to you only upon receipt of cleared payment in full.
7.6 In the case of EFT payments, Goods will only be dispatched once payment has been verified and cleared in our bank account.
7.7 We reserve the right to charge interest on overdue amounts at the rate contemplated in the Prescribed Rate of Interest Act 55 of 1975.
8. DELIVERY
8.1 We will endeavour to execute all Orders within 30 (thirty) days of receipt of your Order, unless otherwise agreed, in compliance with section 46(1) of ECTA.
8.2 If we are unable to deliver within 30 days or within any agreed period, we will notify you. You may then cancel the Order with 7 days' written notice in terms of section 46(2) of ECTA. A full refund will be issued within 30 days of cancellation.
8.3 Delivery times displayed on the Website are estimates only and not guaranteed. We are not liable for delays caused by third-party couriers, force majeure events, or circumstances beyond our reasonable control.
8.4 Risk in the Goods passes to you upon delivery to the address specified in your Order. You are responsible for inspecting Goods upon delivery and notifying us of any damage or discrepancy within 5 (five) business days.
8.5 Delivery charges, where applicable, are non-refundable unless the Goods are defective or incorrectly supplied.
8.6 We currently deliver within South Africa only, unless otherwise specified on the Website.
9. CONSUMER RIGHTS (Consumer Protection Act 68 of 2008)
The following rights apply to Consumers as defined in the CPA. Where you are a juristic person, or where the CPA expressly does not apply, these provisions may not apply in full.
9.1 Right to Information
You have the right to receive clear, accessible, and accurate information about the Goods and Services we offer, including pricing, terms, conditions, and risks, in accordance with section 22 of the CPA.
9.2 Right to Fair and Responsible Marketing
We will not engage in marketing practices that are misleading, deceptive, or unfair. All promotional material is subject to the provisions of sections 29 to 39 of the CPA.
9.3 Right to Fair Value, Good Quality, and Safety
(a) All Goods supplied will be of good quality, in good working order, and free from defects, in accordance with section 55 of the CPA.
(b) All Services will be performed with reasonable care and skill and completed within a reasonable time.
(c) Where Goods are unsafe or defective, you may have rights to a repair, replacement, or refund under sections 55 and 56 of the CPA.
9.4 Right to Disclosure of Recurrent Charges
If any subscription or recurring charge applies, we will clearly disclose this before you commit to the transaction.
9.5 Right to Pre-authorisation
We will not debit your account for any amount not expressly authorised by you in advance.
10. RETURNS, REFUNDS, AND CANCELLATIONS
10.1 Cooling-Off Right (ECTA — 7-Day Right)
In terms of section 44 of ECTA, you have the right to cancel your Order within 7 (seven) days of receiving the Goods, without penalty and without giving a reason, provided that:
- the Goods are returned in their original, unused, and undamaged condition, with all original packaging and documentation;
- you bear the direct cost of returning the Goods, unless otherwise agreed.
We will refund the purchase price within 30 days of receiving the returned Goods in acceptable condition. We may deduct the direct cost of return if we arranged collection.
10.2 Exceptions to Cooling-Off Right
The 7-day cooling-off right under ECTA does not apply to:
- Goods made to your specification or clearly personalised;
- services that have been fully performed with your prior express consent.
10.3 Defective or Incorrect Goods (CPA — 6-Month Right)
If Goods are defective, unsafe, or do not conform to their description, you may, within 6 (six) months of delivery, return them to us and elect one of the following remedies in terms of section 56 of the CPA:
- repair of the defective Goods;
- replacement of the Goods with equivalent Goods; or
- a full refund of the purchase price.
We will not charge you any penalty for exercising these rights. You may be required to provide reasonable evidence of the defect.
10.4 Cancellation of Special Orders
Where you cancel an Order for specially manufactured or customised Goods, we reserve the right to charge a reasonable cancellation fee reflecting our direct costs and commitments already incurred, in accordance with section 17 of the CPA.
10.5 Refund Processing
All approved refunds will be processed within 30 days using the same payment method used for the original purchase, or by agreement with you in writing.
11. PROTECTION OF PERSONAL INFORMATION (POPIA)
We are committed to protecting your personal information in compliance with POPIA and the POPIA Regulations as amended in April 2025.

11.2 Purpose of Processing
We collect and process your personal information for the following purposes:
- processing and fulfilling your Orders;
- creating and managing your account;
- processing payments and preventing fraud;
- communicating with you about your Orders and our Services;
- sending marketing communications where you have given consent or where permitted by POPIA and the 2024 Direct Marketing Guidance Note issued by the Information Regulator;
- complying with legal obligations;

11.3 Lawful Basis
We process your personal information only on one or more of the following lawful grounds: (a) your consent; (b) the performance of a contract with you; (c) compliance with a legal obligation; or (d) our legitimate interests, provided these do not override your rights.
11.4 Direct Marketing
(a) In accordance with section 69 of POPIA and the Information Regulator's Guidance Note on Direct Marketing (December 2024), we will only send unsolicited electronic marketing communications (email, SMS, push notifications) where you have given prior consent, or where you are an existing customer and we are marketing similar goods and services.
(b) Every marketing communication will clearly identify us as the sender and include a clear and accessible opt-out mechanism.
(c) You may opt out at any time by clicking 'unsubscribe' in any email, by contacting us at info@leefsteil.com, or by registering on the preemptive block registry under the CPA.
(d) We will honour all opt-out requests promptly and will not contact you again for marketing purposes once you have opted out.
11.5 Your Rights Under POPIA
Subject to applicable law, you have the right to:
- request access to the personal information we hold about you;
- request correction or deletion of inaccurate or incomplete personal information;
- object to the processing of your personal information;
- request restriction of processing in certain circumstances;
- withdraw consent at any time, without affecting the lawfulness of prior processing;
- lodge a complaint with the Information Regulator at: www.justice.gov.za/inforeg or inforeg@justice.gov.za.
To exercise any of these rights, contact our Information Officer at the details in clause 11.1. We will respond within a reasonable time and no later than as required by law.
11.6 Data Security
We implement appropriate technical and organisational measures to protect your personal information against accidental loss, destruction, unlawful access, or unauthorised processing. However, no internet transmission is completely secure and we cannot guarantee absolute security.
11.7 Data Retention
We retain your personal information for as long as necessary to fulfil the purposes for which it was collected, or as required by law, after which it will be destroyed or anonymised.
11.8 Sharing of Personal Information
We do not sell your personal information. We may share it with trusted third parties (payment processors, couriers, IT service providers) who process it on our behalf and are contractually obliged to keep it confidential and comply with POPIA.
11.9 Cross-Border Transfers
Where your personal information is transferred outside South Africa, we will ensure that the recipient is subject to adequate data protection laws or has agreed to be bound by obligations substantially equivalent to those imposed by POPIA.
12. INTELLECTUAL PROPERTY
12.1 All content on this Website, including but not limited to text, graphics, logos, images, product descriptions, audio clips, software, and the compilation thereof, is the property of the Company or its licensors and is protected by applicable South African and international intellectual property laws.
12.2 You are granted a limited, non-exclusive, non-transferable licence to access and use the Website for personal, non-commercial purposes only. You may not reproduce, distribute, modify, or create derivative works from any content on the Website without our prior written consent.
12.3 Any trade marks, service marks, or logos displayed on the Website are the property of their respective owners.
13. USE OF THE WEBSITE
13.1 You agree not to use this Website:
- for any unlawful purpose or in violation of any applicable South African law, including the Cybercrimes Act 19 of 2020 and the Electronic Communications Act 36 of 2005;
- to transmit or distribute computer viruses, malware, or other harmful code;
- to attempt to gain unauthorised access to any part of the Website or related systems;
- to engage in scraping, data mining, or systematic extraction of Website content without consent;
- to impersonate any person or entity or falsely represent your affiliation.
13.2 We reserve the right to suspend or terminate your access to the Website without notice if you breach these Terms.
13.3 We do not warrant that the Website will be uninterrupted, error-free, or free from viruses. Access to the Website is provided 'as is'.
14. LIMITATION OF LIABILITY
14.1 To the fullest extent permitted by law, the Company shall not be liable for:
- any indirect, incidental, consequential, or punitive damages arising from your use of the Website or the Goods or Services;
- loss of profits, data, goodwill, or business opportunity;
- technical failures, interruptions, or errors in the Website;
- acts or omissions of third-party service providers, including payment processors and couriers.
14.2 Nothing in these Terms excludes or limits our liability for:
- death or personal injury caused by our negligence;
- fraudulent misrepresentation;
- any liability that cannot be excluded or limited under the CPA or other applicable South African law.
14.3 Our total aggregate liability to you for any claim arising from or related to these Terms or the Goods and Services shall not exceed the amount paid by you for the relevant Order.

17. COOKIES AND TRACKING
17.2 You may manage your cookie preferences through your browser settings, but note that disabling certain cookies may affect Website functionality.
18. UNSOLICITED COMMERCIAL COMMUNICATIONS
18.1 In terms of section 45 of ECTA and section 69 of POPIA, we do not send unsolicited commercial communications (spam) to persons who have not consented to receive them.
18.2 Any person who sends us unsolicited commercial communications in breach of section 45 of ECTA may be liable for the costs incurred by us in handling such communications.
19. FORCE MAJEURE
We will not be liable for any delay or failure to perform our obligations under these Terms where such delay or failure results from circumstances beyond our reasonable control, including but not limited to acts of God, fire, flood, pandemic, civil unrest, strike, governmental action, load shedding, or failure of third-party infrastructure. In such circumstances, we will notify you as soon as practicable and will endeavour to resume performance as soon as reasonably possible.
20. GOVERNING LAW AND JURISDICTION
20.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of South Africa.
20.2 You and the Company consent to the non-exclusive jurisdiction of the South African courts for the resolution of any dispute arising from or related to these Terms or the Goods and Services.
20.3 In terms of section 43(1)(r) of ECTA, we provide the following alternative dispute resolution options: [specify any accredited ADR body, consumer ombud, or POPIA-related complaints process]. Alternatively, disputes of a consumer nature may be referred to the National Consumer Commission at 0860 003 600 or www.thencc.gov.za.
21. SEVERABILITY AND ENTIRE AGREEMENT
21.3 No waiver by us of any breach of these Terms shall constitute a waiver of any subsequent breach.
